Tier 2 Sponsorship Licence Employers

There are specific duties as a sponsor of migrant workers under the sponsor licence scheme. You will need to be fully accredited by a recognised regulatory body for your particular profession or industry. The aim of the UK Border Agency is to eliminate all abuse of the system and ensure that those who travel to or remain in the United Kingdom solely for the purposes of obtaining and or remaining in employment are genuine and comply with the immigration rules.

As a sponsor it is your duty to assign certificate of sponsorship for migrant employees under tier 2 of the points based system, when assured that a prospective (and current migrant employees) have the attributes, skills and maintenance level required under the immigration rules. You are required to check adequate previous qualifications, experience and skills and or language skills that are possessed by your prospective employees. Generally you are required to assess to the best possible standard prospective applicants and ensure that they fulfil requirements of the immigration rules to qualify for grants of certificate of sponsorships. You may also need to assess migrant's ability to meet their costs for maintenance for the first month in the United Kingdom unless you are providing their maintenance as required. Remember that the whole scheme is to remove abuse of the route.

Quite importantly sponsors are required to report certain migrant activity. A sponsor is required to report to the UK Border Agency should a migrant worker miss 10 expected contacts, stops working or fails to commence their employment.
